BE IT ORDAINED BY THE COUNCIL OF KING COUNTY: SECTION 1. Findings. A. Homelessness is recognized as a growing problem in King County and other places in the nation. Our regional one-night count of homeless persons estimates that approximately eight thousand three hundred King County residents experience homelessness on any given night. Estimates suggest that over twenty-four thousand King County residents will experience at least one episode of homelessness during the upcoming year. B. King County finds it unacceptable that such a high number of our citizens cannot find safe, decent, affordable and non-time-limited housing. C. Seattle/King county has been relatively successful as a metropolitan area in developing housing and service programs but is still experiencing growth in homelessness while some other areas have shown success in reducing homelessness . A comparison of the one night count between 2001 and 2004 indicates there has been a thirteen percent overall increase in the number of homeless persons living on the streets or in shelters in King County. D. Further analysis of the one night count information indicates that the current increase in homelessness is primarily related to increases among the subpopulations of people who have been homeless for more than two years and single males. Homelessness has decreased for people who have been homeless less than six months and has not increased among youth and families with children. E. The Committee to End Homelessness, a community committee formed by representatives of King County, the city of Seattle and other cities, foundations, the faith community, the business community, nonprofit organizations and homeless individuals, has completed a plan that seeks to end homelessness, not simply manage homelessness, by working together to improve the use of existing housing and service resources as well as generating necessary additional resources. The plan developed by the Committee to End Homelessness, entitled A Roof Over Every Bed in King County: Our Communty's Ten-Year Plan to End Homelessness, a copy of which is Attachment A to this ordinance, calls for the county and other jurisdictions in the region to formally endorse the plan and agree to help implement the plan in a continued partnership under a reconstituted Committee to End Homelessness with a formalized governing structure including a policy and oversight group, which is the governing board, an implementation group, which is the interagency council and which is supported by working committees, and a consumer advisory council, the charter for which is Attachment B to this ordinance. F. Motion 12115 directed the executive to submit the Ten Year Plan to End Homelessness to the council for review and approval along with a related county action plan. G. King County was selected by the Committee to End Homelessness as the entity to facilitate joint implementation of the plan with financial and in-kind staff contributions from the city of Seattle and United Way of King County for a two year start up period. H. King County has established and filled two positions to support the plan governance and implementation process and has appointed the governance board and interagency committee with the advice of the original Committee to End Homelessness members as called for in the plan. I. King County has key regional service system responsibilities for mental illness, substance abuse, developmental disabilities, HIV/AIDS and other acute and chronic health conditions, conditions that place people most at risk for homelessness, particularly repeated or long-term homelessness. J. Federal and state governmental entities have also issued requirements that local planning areas create ten-year plans to end homelessness in their communities, including the passage of Chapter 484, Laws of Washington 2005 (Engrossed Second Substitute House Bill 2163) the Homelessness Housing and Assistance Act. K. Chapter 484, Laws of Washington 2005 provides a new source of funding for services and housing programs implemented as part of a homeless housing plan adopted for a county or other local area and developed with the advice of a local homeless housing task force with volunteer members including at a minimum representatives of county and city government and homeless or formerly homeless individuals. Sections 8, of Chapter 484, Laws of Washington 2005 requires that homeless housing plans be approved by the appropriate local legislative body by December 31, 2005. King County estimates that the recording fee will generate approximately three million dollars per year for the region to spend on a wide range of services and housing designed to prevent and reduce homelessness. L. King County government plans to continue to be a key participant of the regional Committee to End Homelessness, through participation of council and executive representatives in the Committee to End Homelessness governing structure, by providing staff support to, and coordinating county managed resources with, Committee to End Homelessness initiatives and by funding the committee to end homelessness positions and project in partnership with the city of Seattle and United Way. M. It is the desire of the Committee to End Homeless and King County to meet all requirements necessary to use the newly authorized recording fee revenue to help implement the regional plan to end homelessness SECTION 2. A. A Roof Over Every Bed in King County: Our Community's Ten-Year Plan to End Homelessness, a copy of which is Attachment A to this ordinance, is adopted as the King County homeless housing plan pursuant to Chapter 484, Laws of Washington 2005 and endorsed as the guide by which the county and other members of the Committee to End Homelessness will work to reduce and eliminate homelessness over the next ten years. B. The Committee to End Homelessness is designated as the local homeless housing task force pursuant to Sections 3(9) and 8 of Chapter 484, Laws of Washington 2005 and is recognized as the body to coordinate and oversee implementation of the ten-year plan by the county and the other members of Committee to End Homelessness. C. As the joint body overseeing implementation of the ten-year plan, the Committee to End Homelessness is charged with responsibilities for: 1. Recommending policies, priorities and procedures for the allocation of new revenues available pursuant to Chapter 484, Laws of Washington 2005 and appropriated and contracted by the county; 2. Recommending realignment of existing resources, development of new resources and changes in policies and regulations necessary to achieving the goals of the ten-year plan to funders, providers and the broader community; and 3. Developing and overseeing action planning, evaluation and progress reporting processes. D. The Committee to End Homelessness, in conjunction with the department of community and human services shall submit a report to the council by December 31, 2005, describing the policies, priorities and procedures for allocating fund available under Chapter 484, Laws of Washington 2005, the action planning and evaluation processes the committee will be using and the content and schedule for an annual progress report, based on review of key performance measures, to the community, member organizations represented on the Committee to End Homelessness and the state pursuant to requirements of Chapter 484, Laws of Washington 2005. The report due December 31, 2005, shall be filed with the clerk of the council, who shall distribute copies of the report to all councilmembers. E. King County's Response to the Ten-Year Plan to End Homelessness in King County, a copy of which is Attachment C to this ordinance , is accepted as an initial county action plan in support of the region's ten-year plan to end homelessness. F. As its major contribution to the effort to end homelessness in the region, King County commits to bring its substance abuse, mental health, developmental disabilities, HIV/AIDS, health care for the homeless and other health safety-net services, community services, housing, veterans services, community corrections and other law and justice services together to work with each other and the Committee to End Homelessness to create more effective housing and service partnerships with the goal of reversing the growth trends in homelessness for persons with disabling conditions along with continuing to reduce unnecessary, expensive and ineffective involvement in the law and justice and emergency medical systems. G. To achieve the goals of reducing homelessness and criminal justice involvement among persons with disabling conditions, county programs are directed to work together with each other and their community partners to create a system that is client-centered rather than program-centered and that: 1. Recognizes the unique and often multiple needs of each individual and, therefore, coordinates and integrates individual assessment, case planning and service delivery to the maximum extent possible; 2. Strives to prevent homelessness and criminal justice involvement for all persons in care and reaches out to persons in need but not in care, including those on the streets, in shelters and in the criminal justice system or leaving state and local institutions; 3. Strives to move those who are homeless into permanent housing as quickly as possible; and 4. Promotes maximum possible recovery and self-sufficiency. H. The department of community and human services shall provide the council with the Committee to End Homelessness's annual report. They then turned over the plan to the newly forming Committee to End Homelessness for plan implementation. Committee to End Homelessness Phase II (plan implementation) This coalition is responsible for implementing the Ten-Year Plan through a multi-level governance and workgroup structure that involves representatives from government, service and housing providers, the philanthropic community and the private sector. Governance is through: A Governing Board made up of more than 20 influential leaders who provide high-level oversight, and help to sustain the vision and leadership of the plan. More specifically, they will guide planning, coordinate current funding, and work to create additional resources. They have been vested with authority to identify priorities for the use of 2163 funds by King County Council A Consumer Advisory Council comprised of approximately 15 people who are currently homeless or who have experienced homelessness in the past and who represent the broad interests and needs of homeless people countywide. An Interagency Council, comprised of approximately 30 people, and includes department heads and partners working to end homelessness in King County. The Interagency Council works to sponsor changes to current programs; coordinate data collection, analysis and reporting; recommend policy direction to the Governing Board; and create ways to better serve people experiencing homelessness. Finally, Five Committees have been established who will focus on implementation strategies. Three integrate housing and services solutions for the target population groups (Single Adults, Families and Youth). Communications, Public Awareness and Legislative Advocacy will focus on day to day communications, legislative advocacy and creating long term pubic will, and Resource Development and Alignment will focus on creating new resources and maximizing the use of existing resources. The Resource Development and Alignment Committee will serve as the workgroup that will recommend priorities for funds generated under the Homeless Housing Assistance Act (2163) to the Governing Board. Because of the magnitude of the task in King County and the complexity of the needs, it is difficult in the initial planning stage to identify the costs. A sophisticated costing effort is now underway as part of the Ten Year Plan. This effort includes both costing and identification of the extent to which existing resources can be used to accomplish the necessary tasks and, similarly, the extent to which new resources will be needed. As publishing inaccurate or incomplete estimates of these requirements and resources could be very damaging to the long term effort to raise sufficient resources to carry out the Ten Year Plan, King County is taking advantage of the flexibility given in the 2163 reporting requirements to report on only selected initiatives and their costs. The attachment, CEHKC Summary of Homeless Strategic Plan 12-31-05, identifies examples of selected current initiatives and costs. Section 5 - Homeless Services Needs In a narrative format, describe the most important gaps in non-housing services necessary to help homeless persons obtain and maintain stable housing, and prevent at-risk households from becoming homeless. More than 8,000 people experience homelessness on any given night in the suburban cities, urban centers, and rural towns of King County according to 2004 One Night Count. It is recognized that many other members of our community experience homelessness but are not included in this point in time count. Generally speaking, gaps in non-housing services that help people find, and keep housing, center around Prevention, Outreach & Engagement, and Supportive Services. Within each of these areas, however, are important differences relative to the targeted populations. Single Adults have different gaps than families. Families experience different gaps and barriers than Youth. King Countys Ten-Year Plan to End Homelessness identifies multiple strategies for each of these target populations, though at this time we lack the funding, resources and capacity to fully implement these strategies. Single Adults Background: There are more than 5,100 homeless adults per the One Night Count. Of those, approximately 2,500 are estimated to be chronically homeless. Factors that cause homelessness among Single Adults Lack of affordable housing Mental health issues Physical disabilities Substance abuse Criminal histories Lack of discharge systems that create housing Fragmented systems Discrimination Eligibility criteria that restrict entrance or are difficult for residents to comply with Limited employment and educational opportunities  Prevention: Prevention supports are cost-effective, compassionate responses to averting homelessness in our communities. Prevention strategies for adults focus on discharge planning for individuals exiting correction facilities, sobering centers and mental health institutions. Criminal history is an especially difficult barrier to housing for individuals to overcome. Approximately one in seven individuals have a criminal history (WA State Dept of Corrections) and individuals with criminal history are significantly more likely to be homeless than the average population. Although there are no national statistics on homelessness among people leaving correctional facilities, figures from some major jurisdictions suggest a troubling picture. At any given time in Los Angeles and San Francisco, 30 to 50 percent of all people under parole supervision are homeless. In New York City, up to 20 percent of people released from city jails each year are homeless or their housing arrangements are unstable. (Preventing Homelessness Among People Leaving Prison, Vera Institute of Justice, December, 2003) In fact, an individuals discharge from these institutions can represent an opportunity to ensure that individuals not only stay connected or reconnect to services, but that they discharge from these institutional settings to an appropriate, affordable home. Recommendations include developing procedures for discharge planning from local institutions that would identify what an individuals living circumstance is, where the individual will go upon leaving an institutional setting, and their risk of homelessness. This would involve developing tools and guidelines to be used by institutional settings that would assist with coordination between facility staff and community providers. Further recommendations include partnerships with community providers to identify and prioritize housing and rental vouchers for individuals discharging from institutions or at risk of becoming institutionalized. Policies and procedures for transitional activities and firm commitments on the part of housing and services providers would allow for the closing of the door to end chronic homelessness. Outreach and Engagement / Access to Services: Outreach and engagement is a critical component of a successful housing continuum. Low barrier access to services is also critically important. Ideally, services are structured so that there is no wrong door and individuals are able to connect to appropriate services regardless of how they access the system. Gaps at this level include: A single, coordinated location where individuals can access services and case management, knowing they will receive a thorough assessment to identify barriers to housing, coupled with a survival plan and facilitated referrals to all services for which they are eligible. Individuals also need immediate, low barrier interventions and supports for urgent concerns, such as health, mental health and chemical dependency issues. Supportive Services: The majority of homeless single adults require supportive services to succeed in housing. Local estimates of the numbers of individuals requiring on-site supportive housing services are as follows: Intensive supportive housing will be required by over 2,900 individuals, 1,800 of whom are chronically homeless. Types of intensive supportive services needed include treatment on demand for mental health counseling, chemical dependency, medical and dental services, employment and general case management. Specialized services such as these require highly trained on-site staff available round the clock. Moderate supportive housing will be required by over 2,800 individuals, approximately 700 of whom will be chronically homeless. These types of services need to be: low barrier, provide services on demand, establish a sense of community, address safety concerns among residents, and rely on eviction as a last resort for noncompliance. Families Background: There are approximately 2,400 homeless families per the 2004 ONC. In large part, homelessness among families is an economic issue. The living wage for a family in King County is $17.75/hour to afford a two bedroom apartment (Seattle/King County 2004 Benchmark Report). Given the lack of affordable housing, when families become homeless, they tend to stay in the shelter system longer (often up to maximum allowed length of stay of two years) and may cycle through again if there is no affordable housing available at the end of their stay. Providers are also noticing increasing numbers of refugee families. Barriers and housing gaps for these families may be compounded due to eligibility restrictions for TANF, Food Stamps and housing subsidies. Case managers need training to assess, and respond to, the multiple and complex issues that these families face; however, funding for training is not available/allowed by certain fund sources. Typical gaps and barriers experienced by families in finding and maintaining stable housing include: No/Reduced income Medical Treatment Mental Health TreatmentDomestic Violence supports Assistance to respond to Family Emergencies Prevention: The single most critical prevention strategy for families is the provision of affordable housing. Locally, experts predict that 90% of homeless families require housing subsidy, and the availability of a housing subsidy is the single greatest predictor of families ability to remain housed. Further prevention strategies for families including reworking screening criteria that disallow heads of household with a criminal history, poor credit, or income-to-rent ratios that dont meet industry standards. Prevention also includes long-term case management for families exiting homelessness to ensure the familys housing stability and reduce their risk of re-entering the shelter system. Outreach and Engagement / Access to Services: Many families learn of services and programs by networking with other families, rather than through coordinated services or structured outreach efforts. A coordinated outreach and access effort would ensure that we have multiple access points for services that allow for: Resource centers with full range of access points for other services Services delivered on-site to families wherever they reside Culturally appropriate services Linkages with services: DSHS, schools, childcare, etc., where families come into contact with other service providers, and who can provide a linkage to housing/homeless services. Supportive services: Families require supportive services that address the causes of homelessness mentioned above and that build life skills including parenting, family budgeting, literacy, English-as-a-second language, and employment among others. Children within homeless families require supportive services to heal from the trauma of homelessness and gain life skills so as not to repeat the pattern of homelessness. Supports to children include: Expansion of early childhood education Support for homeless / family support workers liaisons in schools Collaborations with local schools to ensure they are in compliance with McKinney-Vento Homeless Assistance Acts requirements as it relates to homeless children and providing children with access to public education; and the Office of Superintendent of Public Instruction to set minimum standards for principals to meet needs of homeless children: Transportation, clothing, supplies, equipment Youth and Young Adults Background: According to the 2004 One Night Count, there are approximately 450 youth aged 14 to 25 who are homeless on any given night. Providers have expressed concerns that this number is under-represented. They estimate that there are as many as 2,000 youth who experience homelessness each year in King County. Factors causing homelessness among youth include: Chemical dependency Domestic violence Disproportionality Sexual minority status High likelihood to be victims of crime Lack of rental history/income/cant sign contractsAdditional complexities/challenges faced by foster children Laws/regulations on housing for youth can impede provision of housing/services to youth Criminal histories and sexual offender status Mental health concerns, either within their family (parents/caregivers) or themselves  Prevention: Youth who age out of the foster care system are at increased risk for homelessness, mental health problems, unemployment, chemical dependency, early parenting and incarceration. Approximately 350-400 youth age out of Washingtons foster care system each year, with only an estimated 30-35% age out having earned a high school diploma or GED. Although 80% of older foster youth in Washington state were receiving independent living services while in care, caseworkers felt that 70% were not prepared for independence. (Foster Youth Transition to Independence Study Final Report, Office of Childrens Administration Research, Washington Department of Social and Health Services, 2004.) Six to twelve months after exiting the system, one third of the youth in a Casey Family Program study were on some form of public assistance. 25.2% of these youth suffered from Post-Traumatic Stress Disorder, which is nearly twice the rate of war veterans, and 22% were homeless for one day or more after turning age 18. Less than 2% had completed a Bachelors Degree (Assessing the Effects of Foster Care. Northwest Foster Care Alumni Study. Casey Family Program, 2003.) Prevention supports for youth focus on extending supports past age 18 for those enrolled in higher education (one of CEHKCs priorities for the 2006 Washington State Legislative Session) and ensuring that each individual has a housing stability plan in place upon their exit from the foster care system. Outreach and Engagement: Outreach strategies for young adults require workers to spend most of their time where youth/young adults hang out on the streets and at drop-in, hygiene centers, and public health clinics to build relationships over time and to link them to case management services, mainstream supports, and housing. Experience tells us that this relationship building takes significantly longer with young adults than other populations sometimes requiring years of contact before an individual will engage in services. Outreach to youth also requires a focus on survival sex and sexual exploitation among the youth/young adults. Supportive Services: Youth and young adults greatly benefit from supportive housing. Youth may still need time to grow/build skills/benefit from mentoring for this reason, transitional housing may be more appropriate than a housing first model. Other supportive service housing models include dormitory style housing connected to employment and education. Regardless of the housing model, however, best practice models of supportive services for Youth and Young Adults incorporate life skills coaching, peer support and community building, enhanced education, employment and training opportunities, support for family-reunification where appropriate, and case management services that address issues specific to residents needs, including mental health, chemical dependency, sexual identity, vacating criminal histories, and other supports required to address barriers to housing noted above. Section 6 - Recommendations for State Legislative and Policy Changes Needed to Address Homelessness Describe the state-level changes in policy and law necessary to achieve the goal of a 50% reduction in homelessness in your county. To advance the Ten Year Plan to End Homelessness in King County (and in all counties), the State needs to accomplish three things. First, the State needs to make the housing status of clients served or supervised by the Department of Social and Health Services, the Department of Corrections and the Department of Veterans Affairs an element of measuring the applicable departments success. We know that mental and physical health services are substantially more effective when the client is housed; we know that recidivism is substantially reduced if a person under parole supervision has housing; we know that veterans are disproportionately homeless. We need the departments to be aware of the relation of housing of their clients to their own success, and to track those housing outcomes. Second, the State needs to simplify and allow flexibility of funding and reporting. Right now, funding streams have so many reporting requirements and are so siloed that will often take 15 funding sources and at least as many reports to develop a project. Along the same lines as the Moving to Work status granted housing authorities by HUD, the State funding sources need to grant flexibility to the Committees to End Homelessness so that funds may be combined and coordinated without a plethora of waiver requests or reports. Finally, the effort to end homeless will need funding for both services and housing. In this regard, it will be extremely if the State can recognize that housing efforts can significantly decrease the expenditures required for prisons and mental and physical health funding. On a more micro-scale, CEHKC has several legislative priorities for the upcoming short session. A one-page description is attached.
